The terms “we,” “us,” “our,” and Task Fairies refer to Task Fairies LLC. The term the “Site” refers to mytaskfairies.com. The terms “user,” “you,” and “your” refer to site visitors, customers, members and any other users of the site.
SERVICE
mytaskfairies.com is a website for Task Fairies LLC, an on demand errand and concierge service (the “Site” and/or the “Services”).
Use of mytaskfairies.com, including all materials presented herein and all online services provided by Task Fairies LLC, is subject to the following Terms and Conditions. These Terms and Conditions apply to all site visitors, customers, and all other users of the site. By using the Site or Services, you agree to these Terms and Conditions, without modification, and acknowledge reading them.
The scope of services being provided by Task Fairies LLC are generally limited to those listed on the mytaskfairies.com website. Task Fairies LLC reserves the right to substitute services equal to or comparable to the services listed if the need arises, without prior notice.
USE OF THE SITE AND SERVICES
To access or use the Site or Services, you must be 21 years of age or older and have the authority to enter into these Terms and Conditions. Information provided on the Site and in the Services related to membership and other information are subject to change.
ACCOUNT CREATION
In order to use the Site or Services, you may be required to provide information about yourself or, if you are creating an account for a company, about your company, including name, email address, and other personal or company information. You agree that any information you give to Task Fairies LLC will be accurate, correct, and up to date.
LAWFUL PURPOSES and financial responsibility
You may use the Site and Services for lawful purposes only and agree that your use of the Services will not violate any local, state, or federal laws or regulations. By using the Services, you agree that Ohio law will govern and apply to any dispute that may arise.
You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Site. Unless agreed to otherwise by us, a credit or debit card must be maintained on file and you will be charged for the full amount of your purchase. You are solely responsible for any and all taxes imposed on or in connection with your use of the Services.
If you are establishing a company account in order to cover the cost of tasks or services to be provided to employees, you acknowledge and agree that the company will be responsible for the cost of the set amount of tasks the company purchases for each employee which will be charged to the credit card on file in the company account. The employee may use their tasks toward any of our other services by purchasing additional add-on or hybrid options, the costs of which will be charged to the employee. If you are an employee using tasks or services provided by your employer and you choose to use your tasks toward any of our other services by purchasing additional add-on or hybrid options, you acknowledge and agree that you will be responsible for the cost of the additional add-on or hybrid options you select, which will be charged to the credit card on file in your account.
REFUSAL OF SERVICE
The Services are offered subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so. No order is deemed accepted by us until payment has been processed. We may at any time change or discontinue any aspect or feature of the Site or Service, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment.
ORDER CONFIRMATION
We will email you to confirm the placement of your order and with details concerning service delivery and ongoing payments. In the event that there is an error in this email confirmation, it is your responsibility to inform us as soon as possible.
DURATION OF AGREEMENT
Once confirmed, we will provide you access to the purchased Services. You agree and understand that access to the Services may at times be influenced and affected by third parties that we use to provide the Services. You agree and understand that no breach of contract or any other action may be initiated against Task Fairies LLC when there are delays in the access of the Service. Task Fairies LLC reserves the right to terminate the Service, and or access to certain features of the Service. We will make reasonable efforts to provide notice but are not required to do so under the terms and conditions of this agreement.
If you are paying on a monthly membership, this allows you access to the Services for 30 days. Failure to pay your monthly membership payment will result in access to the Services being stopped.
CANCELLATIONS & REFUNDS
You may cancel membership at any time upon 30 days’ written notice to us, but due to the nature of the Services no refunds will be made for any membership fees already paid. Once you cancel you will no longer have access to the Services, once your current membership period is completed. No partial refunds are given should you terminate a membership before your renewal date; however, you will retain access to the Services until the end of your payment term. It is entirely your responsibility to ensure that you cancel your account in good time should you no longer require the Services and do not wish to be billed further.
BILLING ERRORS & DISPUTES
Customers have 30 days from the date of the charge to notify us of any billing discrepancies or issues. Failure to report any billing issues within this period may result in forfeiture of all or part of the disputed funds, at our discretion. By continuing to use our services, you agree to this policy.
SERVICE DESCRIPTION
We strive to describe and display the Services as accurately as possible. While we try to be as clear as possible in explaining the Services, please do not accept that the Site is entirely accurate, current, or error-free. From time to time we may correct errors in pricing and descriptions. We reserve the right to refuse or cancel any order with an incorrect price listing.
OUR INTELLECTUAL PROPERTY
The Site and Service contain intellectual property owned by Task Fairies LLC, including trademarks, copyrights, proprietary information, and other intellectual property. Task Fairies LLC’s copyrighted and original materials are provided to you as part of the Services for your individual use only and a single-user license. All intellectual property, including Task Fairies LLC’s copyrighted materials shall remain the sole property of Task Fairies LLC. No license to sell or distribute our materials is granted or implied. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the Site or Service Content or intellectual property, in whole or in part, without our prior written consent. You agree that a breach of these Terms and Conditions will cause irreparable injury to us for which monetary damages would not be an adequate remedy and we shall be entitled to seek equitable relief in addition to any remedies we may have hereunder or at law without a bond, other security, or proof of damages.
CHANGED TERMS
We may at any time amend these Terms and Conditions. Such amendments are effective immediately upon notice to you by us posting the new Terms and Conditions on this Site. Any use of the Site or Services by you after being notified means you accept these amendments. We reserve the right to update any portion of our Site and Services, including these Terms and Conditions, at any time. LIMITATION OF LIABILITY
YOU AGREE THAT UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY, OR ANY OTHER DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR SERVICES OR INFORMATION PROVIDED THEREIN. ADDITIONALLY, TASK FAIRIES LLC IS NOT LIABLE FOR DAMAGES IN CONNECTION WITH (I) ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, DENIAL OF SERVICE, ATTACK, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, OR LINE OR SYSTEM FAILURE; (II) LOSS OF REVENUE, ANTICIPATED PROFITS, BUSINESS, SAVINGS, GOODWILL OR DATA; AND (III) THIRD PARTY THEFT OF, DESTRUCTION OF, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF YOUR INFORMATION OR PROPERTY, REGARDLESS OF OUR NEGLIGENCE, GROSS NEGLIGENCE, FAILURE OF AN ESSENTIAL PURPOSE AND WHETHER SUCH LIABILITY ARISES IN NEGLIGENCE, CONTRACT, TORT, OR ANY OTHER THEORY OF LEGAL LIABILITY. THE FOREGOING APPLIES EVEN IF TASK FAIRIES LLC HAS BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN THE DAMAGES. IN THOSE STATES THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR THE DAMAGES, OUR LIABILITY IS LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY LAW. IN NO EVENT SHALL TASK FAIRIES LLC CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL PURCHASE PRICE OF THE SERVICE YOU HAVE PURCHASED FROM TASK FAIRIES LLC, AND IF NO PURCHASE HAS BEEN MADE BY YOU TASK FAIRIES LLC CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED $100.
THIRD PARTY RESOURCES
The Site and the Services may rely on products and resources from other service providers. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content, products, or policies of third party service providers. Use of or links to third party websites, products or resources do not imply any endorsement by or affiliation with Task Fairies LLC. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or third party service provider products or resources.
INDEMNIFICATION
You shall indemnify and hold us harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses, as well as third party claims and causes of action, including, without limitation, attorney’s fees, arising out of any breach by you of any of these Terms and Conditions, or any use by you of the Site or Services.
SEVERABILITY
If any term, provision, covenant, or condition of these Terms and Conditions is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Terms and Conditions shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.
